Probable Cause
The government will be able to secure a search warrant from a
judge only if the government can show probable cause to believe
that the search will reveal evidence of a crime. “Probable cause”
exists where “the facts and circumstances within their [the
officers’] knowledge and of which they had reasonably trustworthy
information [are] sufficient in themselves to warrant a [person]
of reasonable caution in the belief” that evidence of a crime
would be found in a search.
